Law of Remedies

Rights are traditionally distinguished from remedies in common law countries. Thus, the ‘Law of Remedies’ receives due attention in the common law world: whole textbooks and lectures focus on this topic. Against the background of recent developments in European Private Law, the enforcement of rights deserves due attention in German Law as well. Therefore, exploring a German ‘Law of Remedies’ is considered a genuine research interest. A differentiated approach to the enforcement of rights could enhance balancing the parties’ interests.

Further research areas are:

  • analysing remedies (particularly injunctions),
  • the enforcement of intellectual property rights and personality rights on the internet (intermediary liability),
  • questions surrounding cease and desist letters,
  • questions concerning private enforcement.
